Terms of Use

These Terms of Use ("Terms") govern your access to and use of Personally (the "Service"), operated by Personally ("we," "us"). By accessing or using the Service in any way — including creating an account, applying to a role, posting a requisition, or browsing — you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. What Personally does
Personally helps job seekers complete a short screening questionnaire and, if they meet an employer's stated requirements, book a brief introductory call with a hiring manager. We provide the scheduling and transparency tools; we are not an employment agency, staffing firm, or recruiter, we are not a party to any employment relationship, and we do not guarantee interviews, offers, or outcomes.
2. Eligibility & accounts
- The Service is a hiring platform intended for adults. You must be at least 18 years old to create an account or use the Service. If you are under 18, you may not use the Service, and you may not provide us any personal information.
- You agree to provide accurate information and to keep your account credentials confidential. You are responsible for activity under your account.
- You may not use automated means (including bots, scrapers, crawlers, or similar tools) to access, monitor, copy, or extract data from the Service, or to submit applications or other content. Human-verification (reCAPTCHA) is required when applying.
3. Terms for job seekers
- Honest answers.Screening questions reflect an employer's genuine requirements. Answer truthfully; eligibility to schedule a call depends on meeting every stated requirement. Submitting false or misleading answers is a misuse of the Service and may result in removal of your application and suspension or termination of your access.
- Booked calls. When you book an introductory call, your name, résumé, and questionnaire answers are shared with the relevant hiring manager for that requisition. Please attend calls you book or cancel in good faith. By submitting any content to the Service (including résumés, questionnaire answers, and profile information), you grant Personally a worldwide, royalty-free, sublicensable license to use, reproduce, display, transmit, and process that content solely as necessary to operate and improve the Service.
- Your data choices. If you do not pass screening, you may (a) delete and retract your application, or (b) opt in to be considered for future roles. See the Privacy Policy for how each choice is handled.
- The Workaround Collective. You may optionally consent to link your account to The Workaround Collective, a nonprofit Personally supports (in development). Linking is voluntary and revocable at any time.
4. Terms for employers & hiring managers
- Lawful, non-discriminatory screening (your representation). You are solely responsible for the screening questions you create and for all of your hiring decisions. You represent and warrant that your questions and decisions are job-related, are consistent with business necessity, and comply with all applicable employment, anti-discrimination, equal-opportunity, and privacy laws — including (without limitation) Title VII, the ADA, ADEA, GINA, the FCRA, HIPAA where applicable, and state and local laws (e.g. "ban-the-box" and salary-history rules). You will not ask unlawful questions (e.g. about protected characteristics).
- Compliance acknowledgment & audit log. Before each requisition is published, you must affirmatively acknowledge that your questions are lawful. We record that acknowledgment — with the questions, your identity, and a timestamp — in an audit log. You agree this record accurately reflects your attestation and may be used as evidence in any legal, regulatory, or administrative proceeding, including to demonstrate that the attestation was made.
- Candidate data & data protection. You will use candidate information only to evaluate candidates for the role(s) for which it was provided (or future roles where the candidate has opted in), and you will keep it confidential and secure. Where Personally processes candidate data on your behalf, our Data Processing Addendum applies and you act as the data controller.
- Masked email.We provide a relay email address to protect your team's real addresses. You agree not to circumvent it in ways that defeat its purpose.
- Accurate status. Keep requisition statuses current so candidates see an honest picture of the process.
5. Subscriptions, billing & donations
- Employer plans are offered on either a monthly or an annual term, billed in advance at the price shown for the selected tier and term. Annual plans are offered at a discount (currently 10% off the equivalent monthly price).
- Role allowance & annual reset. Each plan includes an allowance of new roles you may publish per subscription year, as shown on the Pricing page for each tier. Your subscription year runs from the date of your earliest subscription purchase with us and resets on each twelve-month anniversary of that date. This applies whether you pay monthly or annually, and cancelling and later resubscribing does not restart, extend, or reset your subscription year or its allowance. Publishing a role uses one role from the allowance for the subscription year in which it is published. Roles you cancel are not returned to your allowance. Reopening or extending a role you have already published does not use an additional role. If you reach your allowance you may still view, manage, and export your existing roles and data; publishing further roles requires upgrading to a tier with a higher allowance until your allowance resets.
- Automatic renewal.Subscriptions renew automatically at the end of each term (every 30 days for monthly plans, or annually for annual plans) at the then-current price, using your payment method on file, until you cancel. We will provide at least thirty (30) days' prior notice of any price increase before your next renewal date; your continued use after that renewal constitutes acceptance of the new price.
- Cancellation. You may cancel at any time from your account. Cancellation stops future renewals; your subscription remains active for the remainder of the period you have already paid for, and paid features stop automatically at the end of that period. We do not provide partial-period cancellations or interim shut-offs, except where required by applicable law.
- No refunds (monthly plans). Except for the annual money-back guarantee described below and where required by law, all fees are non-refundable and are not prorated, including for unused time, partial periods, or features you did not use. Monthly plan fees are non-refundable.
- Annual plans — 14-day money-back guarantee. If you cancel an annual plan within 14 days of an annual charge — whether the initial purchase or an automatic renewal — we will refund that charge in full and end the subscription. After the 14-day window, annual fees are non-refundable and are not prorated; cancellation stops future renewals and your plan stays active for the remainder of the year you have paid for, after which posting new roles requires an active subscription.
- After a subscription lapses. You retain access to view, edit, manage, and export your existing data and the roles you posted while active. Posting new roles requires an active subscription.
- We currently contribute five percent (5%) of our net subscription revenue (subscription income after payment-processing fees) to The Workaround Collective to fund grants and support for job seekers. This is a voluntary commitment described for transparency only and does not create any obligation to any user. We may modify or discontinue this contribution at any time in our sole discretion upon notice posted to the Service.
- Payments. Payments are processed by our payment provider, Stripe. Personally is the seller of record for your subscription, and any applicable sales tax or VAT is added at checkout where required. Stripe's terms may also apply to the payment transaction.
- Chargebacks & attorney's fees.Filing a chargeback or payment dispute does not by itself cancel your subscription or create a refund right; cancellations and refunds are governed by the terms above. If you initiate a chargeback on a charge that was valid under these Terms, we may dispute it with the card network and pursue the amount owed. To the fullest extent permitted by applicable law, if Personally brings or defends any legal action, arbitration, or collection proceeding arising out of a chargeback, payment reversal, or other failure to pay amounts validly owed, you agree to pay all of Personally's reasonable attorneys' fees, court costs, collection costs, and related expenses incurred in connection with that dispute, in addition to the amounts owed and any interest permitted by law.
- MVP note. In this demo, checkout is simulated and no payment is processed.
6. Third-party services
The Service integrates (or will integrate) with calendars, email, human-verification, and HR systems such as Workday and Greenhouse. Your use of those services is subject to their own terms, and we are not responsible for their availability, accuracy, security, or data practices, or for any loss or damage arising from your use of or reliance on them.
7. Acceptable use, suspension & termination
Do not misuse the Service, including by submitting false or misleading information, impersonating another person, gaming or manipulating the screening process, harassing others, infringing rights, attempting to breach security, or using the Service for any unlawful or fraudulent purpose.
We may investigate suspected violations and may suspend or terminate your access at any time, with or without notice, for any reason or no reason, including for conduct we reasonably believe is fraudulent, dishonest, abusive, or otherwise in breach of these Terms. We may also remove content and report unlawful activity to the authorities. Suspension or termination does not entitle you to a refund except as expressly provided in Section 5.
8. Indemnification
By employers and hiring managers.You agree to indemnify, defend, and hold harmless Personally and its officers, directors, employees, and agents from and against any and all claims, demands, investigations, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the screening questions you create or publish; (b) your hiring, interviewing, rejection, or selection decisions; (c) your violation of any employment, anti-discrimination, equal-opportunity, or privacy law; (d) your breach of these Terms or of your representations above; or (e) your use of candidate data. Personally may, at its option, assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim subject to this section without Personally's prior written consent.
By all users.You similarly agree to indemnify Personally for claims arising out of content you submit or your misuse of the Service. This section, along with Sections 9 (Disclaimers & Limitation of Liability), and any other provisions that by their nature should survive, shall survive termination of your account or these Terms.
9. Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Personally is a scheduling and transparency tool; it does not make hiring decisions, does not review the legality of employer questions, and is not the employer of any candidate. To the fullest extent permitted by law, Personally's total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid to Personally in the twelve (12) months preceding the claim or (b) one hundred dollars ($100). Personally is not liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including without limitation damages for lost profits, lost data, loss of goodwill, or hiring outcomes or employer conduct, however caused and under any theory of liability. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Changes & contact
We may update these Terms at any time. Material changes will be posted here with a new "last updated" date and, where practicable, we will notify you by email or in-app notice. Your continued access to or use of the Service after the updated Terms are posted constitutes your acceptance of the changes.
